AWARD

Vide Ministerial reference dated 20 July 2004 this case was brought before the Industrial Court for an award over the dismissal of Dr. Manorema Kunjappan a/p P.K. Kunjappan by her employer GD Communications Sdn Bhd on 30 May 2001.

The matter was first mentioned on 26 October 2004. Ms Rajaretnam appeared for the claimant but the company's representative was absent. Attempts to serve Notice of Mention dated 11 September 2004 had been made by the Court on the company but were unsuccessful.

The next mention date was set for 30 November 2004. Court requested claimant's counsel to make search at R.O.C. on the latest where about of the company. Company's counsel informed Court that the registered address of the company is at the Company's Secretary office and claimant's counsel was unable to locate the business address of the company. Claimant's counsel requested Court for two weeks to take further instruction from claimant on whether to pursue the matter.

Matter adjourned for two weeks until 15 December 2004. Claimant's counsel on the mention date on 15 December 2004 informed Court that they were having great difficulty locating the company's where about and had asked for leave of the Court to withdraw the suit against the company with liberty to file afresh.

Court struck off case with liberty for claimant to file afresh within 6 months.
