JUDGMENT

Augustine Paul J:

In this case the accused was charged with trafficking in dangerous drugs in the following terms:

Bahawa kamu pada 30 Mac 2000, jam lebih kurang 2.30 petang di rumah No. 144-22Q Tingkat 15, Blok D, Jalan Tun Razak, dalam Bandaraya Kuala Lumpur, Wilayah Persekutuan telah mengedar dadah berbahaya iaitu 905.5 gram cannabis, oleh yang demikian kamu telah melakukan satu kesalahan di bawah seksyen 39B(1)(a) Akta Dadah Berbahaya 1952 dan boleh dihukum di bawah seksyen 39B(2) Akta yang sama.

The accused claimed trial to the charge. The prosecution rested its case on the evidence of Nor Azlina binti Abdullah (PW1), a sergeant attached to the police exhibit stores; Chief Inspector Yip Ngan Chew (PW2), the investigating officer of this case; Zalana binti Baharom (PW3), the wife of the accused; and Inspector Som Chai a/l Din Lian (PW4), the arresting officer. In his evidence PW4 said that on 30 March 2000 at about 12 noon he led a team of police officers to the Shell Petrol Station, Jalan Pahang, Kuala Lumpur upon information received from a member of the public that a male Malay driving a Toyota motor car was carrying dangerous drugs in the car.
