ZUNG ZANG TRADING SDN BHD – Appellant

[1] This appeal emanates from the decision of the Court of Appeal reversing the decision of the High Court allowing the appellant's claim. The decision of the Court of Appeal has since been reported in Kwan Hung Cheong & Anor v. Zung Zang Trading Sdn Bhd, 2018 MarsdenLR 1550 .
[2] The appellant Zung Zang Trading Sdn Bhd (formerly known as "Zung Zang Wood Products Sdn Bhd") (hereinafter referred to as "Zung Zang") filed a writ action in the High Court against the respondents to enforce a shareholders' resolutions passed at its Extraordinary General Meeting ("EGM") held on 26 July 2014.
[3] Essentially the reliefs sought by Zung Zang against the respondents in the writ action were, inter alia, as follows:
(i) An order that the 1st and 2nd respondents do within four days of the date of service of the order on them deliver or cause to be delivered up to the appellant the register book, minute book, common seal, secretarial files, all the accounting and other statutory records, bank statements, bank-in slips, cheque butts, books, files and agreements of the appellant as may be within the custody, control and/or possession of the respondents and/or their agent
