MAHKAMAH TINGGI MALAYA JOHOR BAHRU
KURNIA INSURANS (MALAYSIA) BERHAD LWN. LIM KIAN GUAN DAN SATU LAGI
[Rayuan Sivil: 12B-28-2011]
Insurance policies must be interpreted as written, adhering to their plain meaning, with liability determined by strict adherence to policy terms.
Headnote:(A) Insurance contract interpretation - Liability under policy disputed due to non-compliance with policy terms - Clause on theft coverage excluded loss while equipment not stored in secure premises - Court of 1st instance misinterpreted the clause, ruling against insurer's liability. (Paras 5, 6, 10, 11, 15)
(B) Appellate review principles - Appellate courts should respect trial court's findings unless demonstrably incorrect or unjustifiable - Final findings rely heavily on trial evidence and witness credibility. (Paras 13, 14)
Facts of the case:
The Respondent was a partner in a firm that owned an insured tractor which was stolen from an unsecured location while the policy was active. The insurer denied liability, citing non-compliance with the policy terms.
Findings of Court:
The trial court’s ruling that the theft clause was inapplicable was erroneous. The applicable terms clearly covered the equipment, including the tractor.
Result: Appeal allowed, trial court's order overturned and costs awarded.
