AWARD
1. The Complainant lodged a complaint under section 56(1) of the Act that the Respondent has failed to comply with the provisions of Article 33 - Bonus of the C.A.
2. The matter was fixed for hearing on 5 January 2004 but which date was vacated as the former President was taken ill. The matter was then fixed for hearing five more times thereafter. On the fifth hearing date, the Court was informed that parties were close to reaching a settlement and requested a month's mention date. The Court then fixed 29 November 2006 for mention.
3. On 29 November 2006, the Court was informed that parties had some difficulties in resolving the matter and needed more time to do so. Unhappy about the fact that the matter was still pending since 2004, the Court then fixed a hearing date of 8 February 2007.
4. As the President had to attend a meeting on 8 February 2007, that date was vacated and 16 April 2007 was fixed as the next hearing date.
5. On 13 April 2007, the Court received a letter of even date ref. no. MIEU/A: 145 from the Complainant stating that parties had amicably resolved the matter and that the Complainant wished to withdraw the matter. In the premises, the matter is struck off.
