Background

This reference emanates out of a claim by the Claimant over his dismissal by the Bank.

The undisputed facts of the case based on the Statement of Agreed Facts and the evidence adduced at the hearing are as follows. The Claimant joined the services of the Bank on 15.4.1996, a position which he held right up to the date of his dismissal. Prior to joining the Bank, the Claimant started his banking career with Bank Bumiputra Malaysia Bhd from 1981 to 1985, was a Senior Operations Officer with the Cooperative Central Bank from 1986. From 2.8.1988 he joined KUMB Finance as an Operations Officer and subsequently Senior Operations Officer up to 4.11.1991. From 16.5.1992, the Claimant worked in Public Bank Bhd as a senior operations officer and promoted to Assistant Branch Manager from 1.12.1993 until 31.8.1994. By a contract of employment dated 23.3.1996, the Claimant was employed by the Bank as an Assistant Branch Manager for the Bank's branch office at Petaling Jaya ("PJ Branch") (COB 87). 5

During the period between 2.6.1997 up to the date of the Claimant's dismissal the Acting or Relief Branch Manager of the PJ Branch was one Ong KeanPeng,COW5.
