INDUSTRIAL COURT LANGKAWI
MOHD TAKHIYUDDIN RADZI – Appellant
Versus
PAPAGO SDN BHD (RESORT WORLD LANGKAWI) – Respondent
Award No: 28 Of 2023 [Case No: 6(18)/4-2856/20]
Misconduct requiring dismissal must be proven with clear evidence, focusing on the breach of fiduciary responsibility by the employee.
Headnote:This case, under s 20(3) of the Industrial Relations Act 1967, involves the dismissal of the Claimant by the Company on grounds of misconduct relating to unauthorized financial dealings with an external Association. The court finds that the misconduct has been duly proven, warranting the dismissal as just cause. Key issues include accountability for proven misconduct and the implications of unapproved financial transactions. The central questions hinge on whether the allegations of misconduct were committed and whether these constituted just cause for dismissal. The court emphasized the employer's burden of proof and how procedural failures in inquisition could be remedied, ultimately determining the validity of the dismissal based on confirmed misconduct. In conclusion, the court ruled that the Claimant's termination was valid, affirming the Company's position and dismissing the Claimant's appeal against his dismissal.
