The charge against the accused read that on 17.7.01 at about 1.00 p.m. at the car park of the Harbour Trade Centre, Gat Lebuh Macallum, Georgetown in the district of Timur Laut in the state of Pulau Pinang with intent he had caused the death of one Ong Boon Teck by stabbing him with a sharp weapon and was therefore liable under Section 302 of the Penal Code. FACTS
The first witness for the Prosecution was Lance Corporal Paramasivam. He was on duty at the Pondok Polis at Lebuh Macallum on 17.7.01

when he was informed by a male Chinese that a quarrel was going on at the Car Park of the Harbour Trade Centre. When he arrived at the scene he saw four male Chinese attempting to carry an injured person into a car. Two persons then drove off with the injured person to the hospital. He then informed his superior Inspector Rozi of the incident and subsequently reduced the same into a police report. When Inspector Rozi arrived at the scene he handed over to him the two other male Chinese together with their identity cards.
The second witness for the prosecution was Corporal Wan Hassan who on the material date was attached to the beat base at the General Hospit
