[1] This is a reference by the Director General of the Industrial Relations Department Malaysia dated 26 December 2023 pursuant to s 20(3) of the Industrial Relations Act 1967 , which was received by the Industrial Court of Malaysia on 2 January 2024, arising out of the alleged unfair dismissal of Mohd Amirul Hassan Ahmad Tajuddin (hereinafter referred to as "the Claimant") by USAS Berhad (Universiti Sultan Azlan Shah) (hereinafter referred to as "the Company") on 2 September 2023.
Factual Backgrounds
[2] The Claimant began serving the Company as Assistant Lecturer Grade DS41 on a daily part-time basis from 1 March 2017 until September 2017 vide 1st letter of daily part-time contract (p 19 of CLB-1). The Company extended the Claimant's part-time contract for the period of six (6) months from 4 September 2017 to 3 March 2018 with a daily wage of RM100.00, effective 4 September 2017 vide a letter of 2nd daily part-time contract dated 7 August 2017 (p 1 of CLB-1). Subsequently, the Company extended the Claimant's daily part-time contract (3rd contract) for the period from March 2018 to August 2018.
