HIGH COURT MALAYA GEORGETOWN
CHEW KEA SEW – Appellant
Versus
KALIDAS KOMARA WELO & ANOR (ENCLS 10 40 & 57) – Respondent
[Civil Suit No: PA-22NCVC-152-08/2020]

Petitioner Advocates:Hoh Lee Ian ,Respondent Advocate: N Ahilan

The court ruled that non-compliance with a discovery order does not automatically justify striking out the defence, emphasizing the need for cases to be resolved at full trial when serious issues are present.

Headnote:(A) Rules of Court 2012 - Order 24 r 16 - Application to strike out the Defendant's defence for non-compliance with discovery order - First Defendant failed to comply, but court ruled striking out defence unjust and an abuse of process given prior rulings of the court regarding trial necessity. (Paras 1, 4, 8, 9, 10)

(B) Abuse of Process - Court may only strike out pleadings when justified; non-compliance alone is insufficient to disregard previous court directions for a full trial. (Paras 8, 10)

Facts of the case:
The Plaintiff applied to strike out the Defendant's defence due to non-compliance with a discovery order. The Defendant argued that the claim involved serious issues of fraud and forgery, warranting a full trial.

Findings of Court:
Application dismissed; striking out the defence based solely on non-compliance was unjust as the case needed trial.

Issues: Whether the Defendant's failure to comply warranted striking out the defence, while considering previous court decisions.

Ratio Decidendi: The court held that mere failure to comply with a discovery order does not justify striking out the defence, as the case presented serious triable issues that required full examination.

Result: Application dismissed, no order as to cost.

[3] According to the letter dated 27 October 2023, the First Defendant refuses to fulfil their obligations under the Order for the following reasons:

[a] "...your threat to execute the Order dated 9 February 2023 is baseless in view of the fact that the purported transaction of the Sale of the property that your client asserts is wholly fraudulent and unfounded"; and
