Introduction

[1] This Court has on 3 February 2025 allowed encl 147 [Lampiran 147] with no order as to costs.

[2] The said application was filed by the Respondent Husband (Appellant) under ss 88 and 89 of the Law Reform (Marriage and Divorce) Act 1976 and/or Rules 76, 77 and 91 of the Divorce and Matrimonial Proceedings Rules 1980 and/or the existing jurisdiction of the Court . For convenience, the parties are referred to as the same as they were referred to in the High Court .

Case Summary

(i) Marriage Of Petitioner Wife And Respondent Husband

[3] The Petitioner Wife and the Respondent Husband were legally married on 9 November 2005 at the Kulim Buddhist Association, Kedah and the said marriage was registered at the National Registration Department, Kulim Branch, Kedah through Marriage Register No. Register: KC05 250802.

[4] After the marriage, the Petitioner Wife and the Respondent Husband domiciled at No 15 Jalan Kota Permai, Taman Kota Permai, 14000 Bukit Mertajam, Penang and then moved to No. 22A Jalan Mesra, Taman Saujana Permai 14000 Bukit Mertajam, Penang.

[5] The Petitioner Wife currently resides at 10-01, Berjaya Condominium, Lorong Berjaya Baru 2,14000 Bukit Mertajam, Penang and the Respondent Husband currently resides at A-08-03 Sunway Geo Residences, Persiaran Tasik Timur, Sunway South Quay Malaysia, 47500 Petaling Jaya, Selangor and at No 22A Jalan Mesra, Taman Saujana Permai 14000 Bukit Mertajam, Penang

(ii) Offspring Of The Said Marriage

[6] Living together has resulted in the birth of four (4) children. They are:

(i) Hanson Cheah Chong Xiang (M), born on 1 August 2008, and currently 14 years and 7 months old;

(ii) Lydia Cheah Yi Xuan (F), born on May 31.05. 2010, and currently 12 years and 10 months old;

(iii) Esther Cheah Yi Ling (F), born on March 21.03 2012, and currently 11 years old; and

(iv) Anson Cheah Chong Kai (M), born on March 12.03. 2015, and currently 8 years old.

[7] To be highlighted, currently, the Petitioner Wife provides for and cares for all of the marriage's children, and they reside with the Petitioner Wife at 10-01, Berjaya Condominium, Lorong Berjaya Baru 2,14000 Bukit Mertajam, Penang.

(iii) Consent Order

[8] The Consent Order was recorded on January 29 2024 which states that:

(i) the marriage is dissolved and that the Petitioner Wife and Respondent Husband jointly obtain custody of the children of the marriage, namely Hanson Cheah Chong Xiang, Lydia Cheah Yi Xuan, Esther Cheah Yi Ling, and Anson Cheah Chong Kai; the Petitioner Wife also obtains the right to maintenance (care) and control (control) of the children of the marriage;

(ii) That during every school holiday and/or festival season, the Respondent Husband and the Petitioner Wife will take turns taking the children of the marriage on vacation.

[9] Since only order (ii) above has been in question in the application vide encl 147, which is the subject of this appeal, other orders are unaffected for the record.

[10] The reliefs enumerated below are requested in the application (quoted from the application's original language):

1. Responden Suami diberikan akses munasabah untuk membawa anak perkahwinan iaitu ANSON CHEAH CHONG KAI (No. K/P: 150312-07¬0117) ("Anak Tersebut") bercuti ke London, United Kingdom dari 9 Februari 2025 sehingga 14 Februari 2025 sempena dengan cuti akhir tahun persekolahan sesi 2024/2025 bagi Anak Tersebut;

2. Responden Suami diberi akses munasabah kepada dokumen-dokumen penting Anak Tersebut termasuk tetapi tidak terhad kepada passport Anak Tersebut dan Pempetisyen Isteri dikehendaki menyerahkan dokumen - dokumen tersebut kepada Responden Suami dalam masa tiga (3) hari dari tarikh permohonan ini dibenarkan sekiranya dokumen-dokumen tersebut dalam milikan Pempetisyen Isteri;

3. Kos permohonan ini ditanggung oleh Pempetisyen Isteri; dan

4. Lain-lain relif yang dianggap suai manfaat oleh Mahkamah Yang Mulia ini.
