Reference

[1] This is a reference made under s 20(3) of the Industrial Relations Act 1967 [Act 177] pertaining to the dismissal of Selvarajoo A/L Sockalingam (hereinafter referred to as "the Claimant") by The Fine Wine Merchant Sdn Bhd (hereinafter referred to as "the Company") on 30 August 2023

[2] The reference by the Director General of Industrial Relations ("DGIR") in this case required the Court to hear and determine the Claimant's complaint of dismissal by the Company on 30 August 2023.

Procedural History

[3] Pursuant to the Court 's directive on a date fixed for case management on 8 March 2024, held before Assistant Registrar. The case management was fixed on 6 May 2024, 5 June 2024 and 14 August 2024 and was held before the Chairman, the parties were ordered to file the relevant pleadings on specified dates and fixed for the hearing on 14 October 2024. It must be noted that the Claimant was present while the Company was not present.

[4] Hence, this case was ordered to proceed with the hearing ex-parte because the Company was not present and unrepresented and did not file Statement in Reply and Bundle of Documents as was instructed by this Honorable
