JUDGMENT
Introduction
[1] The appellant, Lee Phaik Chien, is an advocate and solicitor. A written complaint of misconduct was made against her by the respondent, a client of hers. The Disciplinary Committee ("DC") that was set up to inquire into the written complaint recommended to the Advocates and Solicitors Disciplinary Board ("DB") that there was no cause for disciplinary action on the written complaint and that the appellant be reprimanded and censured for her behaviour towards the members of the DC at one of the hearings under s 103C(1) of the Legal Profession Act 1976 ("LPA").
[2] On 24 June 2023, the DB acting under the provisions of s 103E of the LPA rejected the findings and recommendations of the DC and, after hearing the appellant, found the written complaint proven and proceeded to make an order that the appellant pay a fine of RM20,000.00 ("the DB's Order").
[3] The appellant appealed to this court against the DB's Order pursuant to s 103E(1) of the LPA, seeking to set aside the DB's Order and the return of the fine which had been paid. The Bar Council intervened and opposed the appeal. On 22 April 2025, I allowed the appeal, set aside the DB
