Introduction

[1] On 22 March 2023, leave was granted to the applicant, Perwira Alam Sdn Bhd, to commence judicial review proceedings for removing into this Court the decision of the Strata Management Tribunal ("Tribunal") dated 4 August 2022, for the purpose of quashing the same by an order of certiorari

[2] On 17 March 2025, I allowed the judicial review proceedings by making an order quashing the award of the Tribunal and under s 121(2) of the Strata Management Act 2013 ("SMA") with an order that the matter be remitted to the Tribunal and be heard by a different President of the Tribunal.

[3] This judgment contains the reasons for my decision.

Background Facts

[4] The applicant is the developer of a building project known as Arte Subang West. The 2nd respondent is the joint management body (JMB) of Arte Subang West established under s 4 of the Building and Common Property (Maintenance and Management) Act 2007. The project commenced in the year 2012 and was completed on 29 October 2015.
