JUDGMENT

Leonard David Shim J:

A) Introduction

[1] The subject matter before the court are 4 separate Land References jointly heard together from 28th to 30th April 2025 and from 21st to 22nd May 2025.

[2] These Land Reference cases were held pursuant to s 56 of the Sarawak Land Code (Cap 81, 1958 Ed.) (hereinafter referred to as the "Land Code"), whereby the Objectors herein were dissatisfied with the sum awarded by the respondent, for the resumption of the following parcel of lands (hereinafter referred to as "the subject lands"):

[3] At the hearing of this Land Reference cases, the Objectors have called two (2) witnesses namely the Valuer, Sr. LIM TIEN YANG ("OW1") and MR. LIM HUI KONG ("OW2") whereas the respondent have called one (1) witness to testify, namely the Valuation Officer, PUAN ANGELA OYO ENG ("RW1").

B) The Subject Land Before And After The Acquisition/ Resumption

[4] The subject lands were acquired for public purpose for the Turn In And Turn Out Of Existing 275KV Mambong-Matang Transmission Line To Be The Proposed Tondong Substation (Package 6) (hereinafter referred to as "the said project").
