GROUNDS OF JUDGMENT

[1]The appellants’ (plaintiffs) appeal is principally related to the construction of Order 37, and it arises from their application of Enclosure 20 in the High Court inter alia to condone delay. The appellants have not filed an application for direction for assessment of damages within one month from the date of an order or judgment, and on that ground the learned High Court Judge in reliance of the Court of Appeal’s decision as well as the decisions of the High Court had ruled that there was inordinate delay in filing Enclosure 20 and thereby dismissed Enclosure 20.

[3]The dismissal of Enclosure 20 literally means that notwithstanding liability issue was settled in the plaintiffs favour, there will be no damages or compensation, etc. for the plaintiffs arising out of the suit.
