GROUNDS OF JUDGMENT
Introduction
[1]The parties in these suits had agreed for the following applications to be heard together:
(a)the application by Damai City Sdn Bhd (‘Damai City’) pursuant to s 15(a), (b) and (d) of the Construction Industry Payment and Adjudication Act 2012 [Act 746] (‘CIPAA’) read together with O. 7, O. 28 and O. 69A, rr. 1, 2 and 3 and/ or O. 92, r. 4 of the Rules of Court 2012 (‘RC 2012’) in Originating Summons No. WA-24C-149-09/2021 (‘O.S. No. 149’) to set aside the Adjudication Decision dated 18.8.2021 (‘AD’) by the learned Adjudicator, Sr. Nik Hasbi Fathi (‘Adjudicator’) (encl. 1; ‘Setting Aside Application’);
(b)the application by Damai City pursuant to s 16CIPAAO. 7, O. 28 and O. 69A, rr. 1, 2 and 3 and/ or O. 92, r. 4 of the RC 2012 in O.S. No. WA-24C-150-09/2021 (‘O.S. No. 150’) to unconditionally stay the AD (encl. 1; ‘Stay Application’) pending full and final disposal of the fast track arbitration proceedings between the parties arising from the Notices of Arbitration dated 14.8.2020 and 8.10.2020 (‘Arbitration Proceedings’); and
(c)the application by MCCO Overseas (M) Sdn Bhd (‘MCCO’) pursuant to s 28CIPAA(‘O.S. No. 165’) for an order t
