GROUNDS OF JUDGMENT

[1]This is a judgment after full trial. A full trial was conducted on 06.03.2024, 12.03.2024, 19.06.2024 and 20.06.2024. The Court dismissed the Plaintiffs (hereinafter referred to as “OSRAM”) claim against the Defendant (hereinafter referred to as “Michelle”) with costs on 23.04.2025.

[2]The Plaintiff has filed an appeal against this decision. The parties in this judgment will be referred to as they were in the High Court.

[3]The Plaintiffs company specializes in the manufacturing of electronic components and semiconductor-based lighting products, commonly referred to as LEDs.

[4]The Defendant was employed at OSRAM from 14 October 1991 as an Executive Assistant until her termination due to redundancy on 30 September 2015

[5]The last position she held in the company was as Executive Assistant in the Treasury & Commercial Administration Department, from January 2010 until her termination due to redundancy on 30 September 2015. She had been employed by the Plaintiff company since 14 October 1991.
