GROUNDS OF JUDGMENTI. INTRODUCTION

[1]This a counterclaim by Mdm. Chow Cho Tai, a housewife in her 60s, against WT Development Sdn Bhd, Loh Kok Choy, Te Chong @ Tee Kang Swee, Jiwa Rakyat Sdn Bhd, Chan Yong Sin, Lim Ah Lim and Tetuan Abdul Aziz Rahim & Co.

[2]This case involves a tangled web of facts. There are five other civil actions in connection with this current counterclaim. They are (i) civil suit no. 22NCVC-1382-11/2012 (“2012 Writ Action”) brought by the Liquidators of Rimau Indah to recover the Phase 3 Land; (ii) a winding up petition against Rimau Indah in the Kuala Lumpur High Court (Companies (Winding-Up) No. 28 NCC-136-02/2015) (“2^nd Winding-Up Order”); (iii) civil suit no. 22NCVC-709-12/2015) (“2015 Writ Action”) brought by the Liquidators against Jiwa Rakyat, Bukit Rimau, Chin Nyuk Pin and Mdm. Chow; (iv) originating summons no. WA-24NCC-80-03/2016 (“2016 OS”) brought by Mdm.
