GROUNDS OF JUDGMENT
Introduction
[1] This judgment concerns the following four (4) appeals filed by the 3rd to 7th Defendants (“the Banks”) against this Court’s decision with regards to the enclosures below:
i.Enclosure 45: An application filed by Lo Hooi Lin and Maznah binti Baba i.e. the 3rd and 4th Alleged Contemnors to set aside ex-parte leave for committal dated 20.1.2016 obtained by the Banks;
ii.Enclosure 47: An application filed by the 2nd Defendant i.e. the 2nd Alleged Contemnor (“Pavilion Yields”) to set aside ex-parte leave for committal dated 20.1.2016 obtained by the Banks;
iii.Enclosure 61: An application filed by Tan Sri Dato’ Lim Cheng Pow, the 1st Alleged Contemnor (“Tan Sri Lim”) to set aside ex-parte leave for committal dated 20.1.2016 obtained by the Banks; and
iv.Enclosure 38: The Banks’ application for a committal order against the alleged contemnors.
[2] On 23.10.2019, this Court allowed enclosures 45, 47 and 61 with costs. Consequently, enclosure 38 falls and was struck out. Given the fact that enclosure 38 was not heard on merits and the striking out was merely a consequential order, this judgment will only concern enclosures 45, 4
