JUDGMENT

This is my judgment in respect of the 3rd defendant's application (enclosure12) to strike out the plaintiffs claim for damages for procuring and inducingbreach of contract between the plaintiff and the 1st defendant pursuant toOrder 18 Rule 19 (1), (b), (c) or (d) of the Rules of the High Court 1980 and/or inherent jurisdiction of the court.

Brief Facts

The plaintiff had a contract with the 1st defendant. The 2nd defendantis the ultimate holding company of the 1st defendant. The 3rd defendant is a wholly owned subsidiary of the 2nd defendant. Mr. Pascal Voisin is the director of the 1st defendant as well as the 3rddefendant. Subsequent to the contract the position was that the 2defendant and/or the 3rd defendant could perform the contract for the1st defendant. In consequence the 1st defendant terminated the contractwith the plaintiff. And it is the plaintiffs allegation that Mr. Pascalwas instrumental in committing the tort on behalf of the 3rd defendant,and he was the one dealing with the plaintiff, and attended themeeting on behalf of the 3rd defendant, on 18.3.2010.
