Introduction

[1]This is an application (Enclosure 185) by the Respondent (Defendant) under Order 14A of the Rules of Court 2012Order 72 Rules of Court 2012

[2]The Plaintiff has raised the issue of estoppel as a reason for objecting to the Defendant’s application. Since this issue is the main issue, other applications (Enclosures 92, 115 and 188) depend on this issue. The Defendant’s application has been allowed with a cost of RM5.000.00 subject to the allocator fee on 18.07.2023. The Plaintiff has appealed against this decision. The parties are referred to as they were in the High Court.
