MAHKAMAH TINGGI MALAYA SEREMBAN
MOHAMAD HALDAR ABDUL AZIZ, J
SAMSUNG SDI ENERGY MALAYSIA SDN BHD – Appellant
Versus
AL-ADHA @ BADRULHISHAM ZULKAPLI – Respondent
[Saman Pemula No: NA-24IP-1-03/2025]

A claim for breach of confidence requires the plaintiff to clearly specify the confidential information and prove that its unauthorized use by the defendant caused actual detriment; failure to meet this evidentiary burden mandates the dismissal of the claim.

Headnote:(A) Contract Act 1950 - Section 74 - Rules of Court 2012 - Order 7, Order 28, Order 92 Rule 4 - Specific Relief Act 1950 - Sections 41, 52 and 53 - Breach of confidence - Tort of breach of confidence - To succeed in a claim for breach of confidence, a plaintiff must demonstrate three elements: the information must have the necessary quality of confidence, it must have been imparted in circumstances importing an obligation of confidence, and there must be an unauthorized use to the detriment of the party communicating it. A plaintiff must clearly specify the documents or information alleged to be confidential to enable the defendant to prepare a defense. (Paras 1, 7, 10, 11)

(B) Evidence - Tort of breach of confidence - Burden of proof - A plaintiff bears the burden of proving that the defendant used confidential information and that such use caused actual detriment. Mere possession of documents is insufficient if the plaintiff fails to identify the specific information and prove damage resulting from its unauthorized use. (Paras 35, 37, 40)

Facts of the case:
An employer initiated legal proceedings against a former employee, alleging unauthorized printing and removal of documents containing confidential information. The plaintiff sought a declaration of breach of employment terms, specific performance, and permanent and mandatory injunctions, claiming that the former employee failed to return confidential materials, thereby risking irreparable harm. The defendant maintained that documents were either returned or were personal, and that any remaining materials had been disposed of.

Findings of Court:
The court found the plaintiff's case suffered from inconsistent evidence regarding the total number and specific nature of the documents claimed to be confidential. The plaintiff failed to define which specific documents were considered confidential or how their unauthorized use caused detriment to the employer. The defendant's evidence regarding the return and disposal of documents remained largely unchallenged.

Issues: Whether the plaintiff established the specific nature of the confidential documents, whether the defendant breached the duty of confidentiality, and whether the defendant’s actions caused actual detriment to the plaintiff.

Ratio Decidendi: The court ruled that a claim for breach of confidence requires strict proof of the confidential nature of the specific information and evidence of actual detriment. As the plaintiff failed to identify the specific documents and prove resultant harm, the claim for injunctive relief and damages was unsubstantiated.

Result: Plaintiff's Originating Summons dismissed with costs of RM15,000.00 to the defendant.
