2007 MarsdenLR 3614
MAHKAMAH TINGGI MALAYA, KUALA TERENGGANU
AHMAD MAAROP, J
RAMLAH ABDULLAH – Appellant
Versus
TALASCO INSURANCE SDN BHD PERUSAHAAN OTOMOBIL NASIONAL BHD PIHAK KETIGA – Respondent
GUAMAN SIVIL NO: 22-08-2000
An insurer is not liable to indemnify a driver for third-party damages unless the driver was using the vehicle with the express or implied permission of the policyholder. The burden of proving such permission rests upon the party seeking to enforce the judgment against the insurer.
Headnote:(A) Road Transport Act 1987 - Sections 91, 95 and 96 - Indemnity by insurer - Liability of insurer to satisfy third-party judgment - Requirement of permission to drive - An insurer is obligated to satisfy a judgment obtained by a third party against an insured person only if the liability is covered by the terms of the policy (Para 18). The duty to indemnify arises only when the driver is using the vehicle with the express or implied permission of the policyholder. (Para 19)
(B) Insurance Law - Vicarious liability - Burden of proof - It is incumbent upon the claimant to prove that the vehicle was being driven with the owner's permission, either express or implied, to establish the insurer's liability for a third-party claim. (Para 27) The absence of evidence to the contrary does not automatically lead to an inference of implied permission where the driver and the person who initially borrowed the vehicle are not authorized representatives of the owner. (Para 31)
Facts of the case:
The plaintiff, having suffered injuries in a road accident, obtained a judgment against the driver of the offending vehicle in a previous suit. Subsequently, the plaintiff sought to enforce this judgment against the insurer of the vehicle. The insurer contended that the driver was not an authorized user of the vehicle, which was a company-owned asset, and thus the policy did not cover the driver's liability. The plaintiff claimed that the vehicle was driven with the implied permission of the insured company.
Findings of Court:
The court found that there was no evidence of express or implied permission granted by the owner to the driver. The driver himself admitted he did not have permission from the owner to use the vehicle. The court emphasized that the mere bailment of a car does not extend to an unlimited right of use for third parties without the owner's knowledge or authorization.
Issues: Whether the insurer of the vehicle is liable to indemnify the driver for the judgment debt incurred by a third party, specifically whether the driver was using the vehicle with the owner's express or implied permission.
Ratio Decidendi: The insurer's liability for a third-party motor accident is contingent upon the driver being covered under the policy, which requires the vehicle to be used with the consent of the insured. As the plaintiff failed to establish that the driver had the authority or permission (express or implied) of the owner, the insurer cannot be held liable to indemnify the driver's liability.
Result: The plaintiff's claim against the defendant was dismissed with costs.
PENGHAKIMAN
Ahmad Maarop H:
