MAHKAMAH TINGGI MALAYA TEMERLOH
ROSLAN MAT NOR, J
GM AERO SUPPORT SDN BHD – Appellant
Versus
PENGARAH TANAH DAN GALIAN PAHANG & YANG LAIN – Respondent
[Saman Pemula No: CB-24-1-03/2024]

Petitioner Advocates:Tan Jia Shen ,Respondent Advocate: Munirah Samsuddin

An appeal under section 418 of the National Land Code is restricted to decisions by the State Director, Registrar, or Land Administrator. Decisions issued by the State Authority are not subject to such appeals and must be challenged through different legal proceedings.

Headnote:(A) National Land Code - Section 418 - Appeal to Court - Scope and limitation - Provisions apply exclusively to decisions made by the State Director, Registrar, or Land Administrator - Decisions made by the State Authority fall outside the scope of Section 418. (Paras 19, 32, 34)

(B) Appeals - Computation of time - Time limit for filing an appeal commences from the date the decision is communicated to the aggrieved party with sufficient information to mount a challenge, rather than the date of the underlying decision. (Paras 24, 26)

(C) Aggrieved Party - Definition - A party whose property rights or access to land are directly affected by a land decision has the requisite standing to initiate an appeal under the relevant statutory framework. (Paras 28, 29)

Facts of the case:
The Applicant challenged the state's decision regarding the alienation of certain land parcels, claiming that this effectively deprived them of the use of a primary access road. The Applicant maintained that they became aware of these decisions and the resulting impact on their commercial development plans only upon receiving specific documents during separate proceedings. The Respondents argued that the Applicant lacked standing and that the appeal was time-barred or filed under the incorrect procedure.

Findings of Court:
The Court found that the Applicant was an 'aggrieved party' with standing to challenge the decision. It further held that the appeal was filed within the statutory limitation period, as time began to run from the date the Applicant received effective notice and information of the decision. However, the Court determined that the decisions in question were made by the State Authority, not the delegated officials covered by the relevant statutory appeal provision.

Issues: The main issues were whether the appeal reached the Court within the prescribed timeframe, whether the Applicant held the necessary standing as an 'aggrieved party', and whether the challenged decision fell within the scope of the statutory appeal mechanism.

Ratio Decidendi: While the Court rejected the preliminary objections regarding limitation and standing, it ruled that the statutory appeal mechanism under the Land Code is strictly limited to decisions by specific land authorities and does not extend to decisions emanating directly from the State Authority. Consequently, the challenge brought under that specific section was procedurally improper.

Result: Application dismissed with costs.
