JUDGMENT

Haidar Mohd. Noor J:

The defendants, Keruntum Sdn. Bhd., ("Keruntum") filed by way of summons in chambers dated 18 May 1989 (Encl. 21) for an order:

(1) that the statement of claim herein be struck out on the grounds that there is no cause or reasonable cause of action, that it is frivolous and/or vexatious, or that it is an abuse of process of the Court;

(2) that alternatively, if the Court rules that the statement of claim is not to be struck out, the time to file and serve the defence is extended one (1) week from the date of such ruling;

(3) further and alternatively, that the order of the temporary injunction granted herein and dated 18 April 1989 be discharged on the grounds that this honourable Court has no jurisdiction to grant the temporary injunction, alternatively that the plaintiff fails to show that defendants' intended action is an abuse of Court's process, or on the ground of material non-disclosure or on other grounds as stated in affidavit of Lim Yew Yuat @ Lim Jew Juat affirmed on 8 May 1989.
