The accused was acquitted and discharged at the close of the case for the prosecution on the following amended charge:
Bahawa kamu, pada 18 Mei 1994, jam lebih kurang 2.20 petang di rumah No 28B, Jalan Lurah 12, Kempas Baru, Tampoi, dalam daerah Johor Bahru, Johor telah bagi pihak diri kamu sendiri melakukan satu perbuatan sebagai persediaan untuk memperedarkan dadah berbahaya, iaitu sejumlah 634.7g ganja, dan dengan itu kamu telah melakukan satu kesalahan di bawah s 39B(1)(c) Akta Dadah Berbahaya 1952 dan boleh dihukum di bawah s 39B(2) Akta yang sama.
It would be tedious in the extreme to rehearse and repeat in detail the facts of the case. Suffice for me to say that both ASP Abu Bakar bin Mohamad ('SP4' – 'Bakar') and Detective Lance Corporal 84882 Abdul Salam bin Haji Zabidi ('SP5' –'Salam') witnessed through the window naco of the rear portion of the house just prior to the raid, the accused (in shorts and barebodied) squatting on the floor of the kitchen and filling dried leaves, believed to be cannabis, which was placed on a newspaper ('P6A') into small plastic packets.
