JUDGMENT

Abdul Malik Ishak J:

I made a ruling sometime ago that the action be restricted between the present plaintiff and the present defendant without having to cite as 2nd to 5th defendants certain government departments including the Government of the State of Johore. The ruling has since been reduced in writing and circulated to all the parties but unfortunately it was not yet reported. No appeal was also lodged in regard to that judgment. This judgment is a product of a full hearing.

The plaintiff, MBF Property Services Sdn Bhd, were said to be the managers for Asal Gemilang Sdn Bhd and Mega Canggih Sdn Bhd under a power of attorney vide no: 39491/93 and had its registered address at 3rd Floor, Wisma MBF, 37C, Jalan Meldrum, 80000 Johor Bahru, Johor. It is not disputed that the defendant was the registered proprietor of a piece of land measuring 178533 square feet held under H.S.(D) 215657, Lot PTD 26138, Mukim Plentong, Daerah Johor Bahru, Johor (hereinafter referred to as the "defendant's land").
