JUDGMENT

Abdul Malik Ishak J:

This was an application by the plaintiff in encl. 77 for a stay of Johor Bahru High Court civil suit no: 22-156-1996 pending the completion of Johor Bahru Sessions Court arrest cases - bearing numbers 62-20, 21 and 22 of 1996. Enclosure 77 was supported by the affidavit of the plaintiff himself one Dato' Ding Lian Cheon as seen in encl. 76 and that affidavit was affirmed on 27 November 1997 and filed on 8 December 1997. The first defendant by the name of Yap You Jee and the third defendant by the name of Haji Johari bin Mansor resisted and challenged the plaintiff's application in encl. 77. In so far as the second defendant - Md Jhomi bin Md Supian, was concerned, the plaintiff had procedurally and successfully obtained judgment in default of appearance on 30 September 1996 and so the plaintiff had only to reckon with the first and third defendants in so far as encl. 77 was concerned.
