GROUNDS OF DECISION

In his statement of claim dated 19th January 1993 the Plaintiff sought the following reliefs:

(a) A declaration declaring that the Lease Agreement No. 82/112, Guarantee and Indemnity and the Charge Presentation No: 64/83 Volume 18 Folio 85 over the land held under G.M. No. 213 f or Lot No: 3269 in the Mukim of Pedah in the District of Jerantut in the State of Pahang Darul Makmur are null and void;

(b) An Order that the Defendant do forthwith deliver to the Plaintiffs the Lease Agreement No. 82/112, Guarantee and Indemnity and other documents pertaining to the said lease for cancellation;

(c) An Order that the Defendant do forthwith deliver to the Plaintiffs' solicitors the duplicate copy of the Memorandum of Charge and the issue document of title to the land held under G.M. No: 213 for Lot No: 3269 in the Mukim of Pedah in the District of Jerantut and in the State of Pahang Darul Makmur;

(d) An Order that the Defendant/Chargee shall fourteen (14) days from date of the Order to be made herein execute a registrable Memorandum of Discharge of Charge Presentation No: 64/83 Volume 18 Folio 85 against the whole of the land held under G.M. No: 213 for Lot No: 3269
