JUDGMENT

Ahmadi Asnawi JCA:

[1] In the Court below, both the appellants were convicted and sentenced to suffer the death penalty on account of the following charge:

"Bahawa kamu bersama-sama pada 24 Jun 2012, jam lebih kurang 8.30 malam, di tepi Jalan Mawar 9, Persiaran Aman Jaya 3, Bandar Aman Jaya, Sungei Lalang, di dalam Daerah Kuala Muda, di dalam Negeri Kedah Darul Aman, telah didapati mengedar dadah berbahaya iaitu heroin seberat 66.0 gram dan monoacetylmorphine seberat 25.5 gram dan dengan itu kamu telah melakukan suatu kesalahan di bawah s 39B(1)(a) Akta Dadah Berbahaya 1952 yang boleh dihukum di bawah s 39B(2) Akta yang sama dan dibaca bersama-sama s 34 Kanun Keseksaan".

[2] The appeal before us was in respect of the said convictions and sentences.

[3] We dismissed the appeal and we now give our grounds.

The Case For The Prosecution

[1] On 10 June 2012, Insp Mohd Sahran Haji Tarmizi (Insp Sahran) had received information from his informer of a certain individual involved in drug trafficking activities in Sungai Petani.
