The present application is filed under Section 22(3)(b) of the Insolvency
and Bankruptcy Code, 2016, by the Punjab National Bank (Financial
Creditor) for and on behalf of the Committee of Creditors (COC) for
replacement of the Interim Resolution Professional by a Resolution
Professional with the following prayer:
“It is prayed that this Hon’ble Adjudicating Authority may kindly be
pleased to forward the name of proposed Resolution Professional, Sri

The facts in brief are that in the instant case the application filed by the
Corporate Debtor Namely M/s. Navya Agro Products Pvt. Ltd. under Section
10 of the IBC was admitted by this Hon’ble Tribunal by Order dated
16.08.2021. This Tribunal also appointed Shri Vakati Balasubramaniam
Reddy as an Interim Resolution Professional (IRP) to oversee the Corporate
Insolvency Resolution Process (CIRP) and to perform the necessary connected
duties and obligations in accordance with the Code and the Rules and
Regulations.

Thereafter, the said IRP has been performing the duties as deemed
Resolution Professional and in the meantime, a Resolution Plan has also been
submitted by NK Power and Infrastructure Ltd. In the 3rd meeting of the CoC
