The present application is filed by applicant namely Dina Chemicals and

Fibres Private Limited u/s 60(5) of Insolvency & Bankruptcy Code, 2016

seeking condonation of delay in filing the application before the Resolution

Professional. Counsel appearing for the applicant submits that there is delay

of approximately 75 days in filing the claim before the RP. Counsel for the RP

present and submits that the CoC has approved the Resolution Plan which is

pending for consideration before this Bench. Be that as it may the delay in

filing the claim before the RP is condoned. RP is directed to verify the claim

in terms of Section 53 of the Code. With the aforesaid observation

IA No. 3239/2022 is allowed and disposed of. List IA Nos. 2871/2022,

1493/2022, 2206/2022 on 23.02.2023.
