Bandula Karunarathna J. P/CA This is an application for grant and issue a mandate in the nature of a Writ of Quo Warranto requiring the 1st Respondent to show by what authority she claims to hold office and continues to function as a Member of Parliament of the Democratic Socialist Republic of Sri Lanka. Further the petitioner request to grant and issue a mandate in the nature of a Writ of Quo Warranto declaring that the 1st Respondent is disqualified to be a Member of Parliament and is thus not entitled to hold office as a Member of Parliament of the Democratic Socialist Republic of Sri Lanka.
When this matter was taken up before this court on 02.03.2023, the learned President Counsel appearing on behalf of the 1st Respondent indicated to Court that he wishes to raise few preliminary objections.
The preliminary objections are as follows;
i. The Petition of the Petitioner has not been filed in compliance with Rule 3 (1) (a) of the Supreme Court Rules and should be dismissed in limine.
