This is an application preferred by the claimant-petitioner-petitioner (hereinafter referred to as the petitioner) seeking to invoke the discretionary remedy of revision granted to this Court by Article 138 of The Constitution.

This matter was supported for notice on the respondent-respondents mentioned in the petition, and also for an order staying the operation of the order dated 11- 07-2024 by the learned High Court Judge of the Provincial High Court of Central Province Holden in Matale, and also the order dated 05-11-2019 by the learned Magistrate of Matale, until the final conclusion of this application.

The learned State Counsel who represented the Hon. Attorney General as well as the complainant-respondent-respondent objected to the issuance of formal notice in this regard and also the stay orders as sought on the basis that there exist no obvious exceptional grounds for this Court to issue notice.

This is a matter where the accused person mentioned in the petition has been charged before the Magistrate’s Court of Matale in Case Number 56190 for having transported Mahogany and Gini Sapu timber valued at Rs. 62,717.92/= in the vehicle bearing number 226-9
