Fundamental rights-Articles 24(3) and (5) of the Constitution-Right to a translation of the record-Restrictions on the application of Article 24(3)-Abuse of process

Article 24(3) of the constitution makes provision for a person to obtain a translation of the record maintained in court.

However, the legislature has restricted the application of this Article to a judge, juror, party or applicant or any person legally entitled to represent such party or applicant in the proceedings of a case, to obtain a translation of the proceedings maintained in the court, if he is not conversant with the language used in court. The restrictions imposed shall not be interpreted in such a way that it will result in delay or abuse of process in the administration of justice.

APPLICATION under Article 126 of the Constitution for infringement of fundamental rights.
