Judgment

1. Petitioners Jarnail Singh and Gurmail Singh apprehending their arrest in a non-bailable offence in case FIR No.381 dated 26.6.2006 under sections 326/324/323/506/148/149 IPC, registered at Police Station Sadar patiala, have filed this petition under Sec.438 Cr. P. C. for anticipatory bail.

2. This order may be read in continuation of the order dated 15.9.2006. I have heard counsel for the parties and gone through the contents of the FIR. Counsel for the petitioners contends that all the petitioners are armed with sticks and have been attributed simple injuries. Counsel for the petitioners further contends that in view of the aforesaid order, the petitioners have joined the investigation. Counsel for the respondent-State on instructions from Faqir Singh, H. C. , does not dispute this fact and further states that the petitioner is no more required for further interrogation.

3. In view of the above, the interim bail, granted vide order dated 15.9.2006 is made absolute subject to the same terms and conditions. This bail order shall remain in operation till the investigation culminates into filing of challan under Sec.173 Cr. P. C. except for material change in the circumstan
