...RESPONDENT

THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND

OF THE CODE OF CRIMINAL PROCEDURE PRAYING TO CALL FOR

2

THE RECORDS WHICH ULTIMATELY RESULTED IN PASSING THE

ORDER ANNEXURE-A DATED 03.07.2018 TRANSFERRING THE

SPECIAL C.C.NO.599 OF 2015 TO THE CJM, BELLARY AND

QUASH THE ORDER DATED 03.07.2018 VIDE ANNEXURE-A

PASSED BY THE XXIII ADDITIONAL CITY CIVIL AND SESSIONS

JUDGE,

SPECIAL

JUDGE,

BENGALURU

URBAN

DISTRICT,

BENGALURU IN SPECIAL C.C.NO.599 OF 2015 TO CJM, BELLARY

AND ETC.

THIS WRIT PETITION COMING ON FOR PRELIMINARY

HEARING, THROUGH VIDEO CONFERENCE, THIS DAY, THE

COURT MADE THE FOLLOWING:

O R D E R

Heard learned counsel for petitioner.

This petition, in my view, is wholly misconceived. The only

ground on which the petitioner has sought intervention of this

Court is that in violation of the order passed by this Court in

Crl.P.No.2512/2017, the court below has transferred Spl.

C.C.No.599/2015 to CJM, Bellary and the Prl. Civil Judge and

JMFC, Hospete, Bellary has taken cognizance of the said

offences. If so, the proper remedy for the petitioner is to

approach the very same court in Crl.P.No.2512/2017 and report

the violation of its order and take further orders from the Court.

3

Hence, reserving liberty to the petitioner to move

necessary application in pending Crl.P.No.2512/2017 for the

relief claimed in this petition, the petition is disposed of.
