The present bail application has been filed under Section 439

of Cr.P.C. on behalf of the petitioner who is in custody in

connection with F.I.R. No. 03/2020, Police Station Hindumalkot,

District Sri Ganganagar for the offence under Section 8/22 of the

N.D.P.S. Act.

Heard learned counsel for the petitioner and learned Public

Prosecutor. Perused the material available on record.

Learned counsel for the petitioner submits that the recovery

of contraband in the present case is below commercial quantity.

There is no other case of like nature pending or decided against

the petitioner. He, therefore, prays that the petitioner may be

enlarged on bail.
