Heard learned counsel for the applicants, learned Public
Prosecutor and learned counsel appearing for the complainant,
and also perused the material available on record.
An F.I.R. No.230/2019 came to be registered at Police
Station-Kherapa, District Jodhpur, inter-alia against the applicants
for the offences punishable under Sections 341, 323, 354, 325 &
307/34 of IPC.

Learned counsel appearing for the applicants submits that as
per injury report and x-ray report, injured- Puski, has suffered five
injuries, out of which Injury No.1 is found grievous in nature,
caused on left hand. Smt. Jimna has received three injuries, out of
which Injury No.1 is endangerous to life, caused on parietal bone
and Injury No.2, caused on right forearm, is found to be grievous
in nature.
It is submitted that injuries caused, which are found to be
dangerous to life, are attributed to Deepa Ram, at whose instance,
an axe is recovered. It is submitted that no specific overtact has
been assigned to the applicants herein and none of the injuries
caused to the victim are attributed to them.
Learned Public Prosecutor and learned counsel appearing for
the complainant vehemently opposed this bail application. It is
submitted that looking to the nature of the injuries, applicant do
not deserve to be enlarged on bail.
Having regard to the facts and circumstances of the case and
without expressing any opinion on the merits of the case, this
Court is of the opinion that the bail application filed by the
applicants deserves to be accepted.
Consequently, the bail application filed under Section 439
Cr.P.C. is allowed. It is ordered that applicants (1) Smt. Indra
Devi W/o Deepa Ram, (2) Sahdev S/o Deepa Ram and (3)
Bhagwan Ram S/o Deepa Ram, arrested in FIR No.230/2019
registered at Police Station-Kherapa, District Jodhpur shall be
released on bail; provided each of them execute/s personal bond
in the sum of Rs.50,000/- and two sureties of Rs.25,000/- each to
the satisfaction of the learned trial Court with the stipulation to

appear before that Court on all dates of hearing and as and when
called upon to do so.
