UPON hearing the counsel the Court made the following

Heard.

The order under challenge is an order passed by a Single

Judge of the High Court of Calcutta. It is not in dispute that

an appeal lies, against any such order, before a Division Bench

of that Court. We see no reason why the petitioner should have

rushed to this Court instead of filing an appeal before the

Division Bench of the High Court. This special leave petition

accordingly fails and is hereby dismissed, reserving liberty

for the petitioner to seek redress by way of an appeal before

the Division Bench of the High Court, if so advised. We make
