We have heard learned counsel for the parties.

This transfer petition has been filed by the

petitioner seeking transfer of Writ Petition (Civil)

No.2989 of 2015 titled as Simplex Infrastructures

Limited versus Union of India and Others, pending

before the High Court of Delhi to this Court.

Having considered the submissions made by learned

counsel for the parties, we are of the opinion that

this transfer petition deserves to be allowed as the

issue involved is pending for consideration of this

Court in Civil Appeal No. 6571 of 2014.

Therefore, the Transfer Petition is allowed. Writ

Petition (Civil) No. 2989 of 2015 titled as Simplex

Infrastructures Limited versus Union of India and

Others, pending before the High Court of Delhi is
