O R D E R

The office report indicates that Respondent No.2 has refused

to accept the service of notice sent to him. This refusal on his

part constitutes proper service but no one has entered appearance

on his behalf.

Ld.Counsel for respondent No.1 submits that he will file the

counter affidavit during the course of the day. This is taken on

record. Advance copy of counter affidavit is taken
