HIGH COURT MALAYA KUALA LUMPUR
SURUHANJAYA SEKURITI MALAYSIA – Appellant
Versus
CHAN SOON HUAT – Respondent
[Suit No: 22NCC-150-05/2015]
Insider trading violations, judged on circumstantial evidence and materiality of non-public information, fall under statutory provisions allowing civil actions and recovery of damages.
Headnote:This case concerns insider trading against the defendant, Chan Soon Huat, whereby the Securities Commission Malaysia asserts he disposed of his shares while in possession of confidential information relating to a significant contract cancellation. The court finds that circumstantial evidence adequately indicates the defendant had inside information at the time of disposal, contravening Section 188(2)(a) of the CMSA. The court determined that the information was material and had a substantial effect on the market, ruling in favor of the plaintiff for statutory damages set at triple the profit gained plus a civil penalty. The court also emphasizes that the standard of proof in civil cases is on the balance of probabilities, allowing for the admission of circumstantial evidence.
