The court intended to balance public interest with the rehabilitation of first-time offenders in sentencing for harboring migrants.

A. Background

[1] The 2 Accused Persons were charged before this court for harbouring/concealing migrants who were smuggled into the country, an offence under s 26H of the Anti-Trafficking of Persons and Anti Smuggling of Migrant Act 2007 (ATIPSOM) - ("The Act").

[2] After the charge was read and explained to both the Accused Persons, and after having understood the charge, both the Accused Persons pleaded guilty. After they were explained of the consequences of their plea and understood them, both the Accused Persons maintained their plea of guilty.

[3] After the facts of the case were read and explained to both the Accused Persons and after having understood them, both of them admitted to those facts, the court thereafter convicted them.

[4] Upon hearing submissions from both parties, this court sentenced both of the Accused Persons to 3 years and 6 months imprisonment effective from the date of their completing serving their previous sentences ie 13 March 2019 and 16 July 2019 respectively.

[5] Dissatisfied, the Public Prosecutor/Appellant filed an appeal to the court of Appeal on their sentences. These are the grounds for the decision.

B. The Charge

[6] The charge reads as follows:

"Bahawa kamu bersama-sama pada 06 Febuari 2018 jam lebih kurang 11.00 malam bertempat di sebuah rumah no 49H Kedai Lama, Rantau Panjang, di dalam Daerah Pasir Mas, di dalam Negeri Kelantan telah didapati menyembunyikan dan melindungi (17) orang lelaki dan (5) orang perempuan warganegara asing iaitu:

1) Suraiming Nicha, lelaki W/Negara Thailand umur 34 tahun

2) Thet Naing, lelaki W/Negara Myanmar umur 40 tahun

3) Tahan Oo, lelaki W/Negara Myanmar umur 30 tahun

4) Ayng Zaw, lelaki W/Negara Myanmar umur 37 tahun

5) Kuaw San, lelaki W/Negara Myanmar umur 40 tali un

6) Soe Neing, lelaki W/Negara Myanmar umur 40 tahun

7) Thien, lelaki W/Negara Myanmar umur 25 tahun

8) Sulam Mung, lelaki W/Negara Myanmar umur 20 tahun

9) Ngin Suan Lian, lelaki W/Negara Myanmar umur 16 tahun

10) Nayla, lelaki W/Negara Myanmar umur 20 tahun

11) Tun Tha Woo, lelaki W/Negara Myanmar umur 40 tahun

12) Aung Nay Min, lelaki W/Negara Myanmar umur 20 tahun

13) Way Linn, lelaki W/Negara Myanmar umur 23 tahun

Dengan cara mengunci rumah dari luar dengan mangga bagi mengelakkan daripada ditangkap dan dengan itu kamu telah melakukan satu kesalahan yang boleh dihukum di bawah s 26H Akta Anti Pemerdagangan Orang dan Anti Penyeludupan Migran 2007 yang mana ianya merupakan kesalahan keselamatan di bawah Akta Kesalahan Keselamatan (Langkah- Langkah Khas) 2012 dan dibaca bersama s 34 kanun keseksaan.

C. The Facts Of The Case

[7] The facts of the case can be gleaned from the exh P..... which was earlier tendered as follows:

1) Pada 06 Febuari 2018 jam lebih kurang 3.00 petang, Pengadu Insp G/20172 Nor Azura Zahari bersama (5) anggota JSJ IPD Pasir Mas buat tangkapan terhadap (3) lelaki setelah hasil soal siasat terlibat dengan s 26H Akta Anti Penyeludupan orang dan Antipemerdagangan Migran di Perkarangan Balai Polis Rantau Panjang, Kelantan.

2) Tangkapan dibuat setelah tangkapan awal oleh Insp G/16158 Mohamad Idris Abdul Majid bersama (15) orang Pegawai dan Anggota Batalion 7 PGA,
