2018 MarsdenLR 1314
HIGH COURT MALAYA KUALA LUMPUR
KETUA PENGARAH HASIL DALAM NEGERI – Appellant
Versus
RAINFOREST HEIGHTS SDN BHD – Respondent
[Civil Appeal No: WA-14-9-06/2018]
The court reiterated that failure to comply with statutory requirements in tax assessments renders notices null and void, emphasizing the distinct provisions of tax law.
Headnote:In this appeal arising from a decision of the Special Commissioners of Income Tax, the court analyzed the application of sub-section 140(1) of the Income Tax Act 1967. The respondent's share transactions were scrutinized for compliance with market value stipulations. The key findings determined that the SCIT's decision lacked legal error and was supported by evidence. The issues addressed included the appellant’s failure to specify statutory provisions applicable to the additional assessment notice, the necessity of providing transaction particulars, and whether the price variation invoked by the appellant was legally sound. The conclusion reaffirmed the SCIT's ruling, affirming no grounds for the appellant’s tax adjustments.
Result: The appellant's appeal is dismissed.
