[Criminal Appeal No: 05-209-10-2015]

Petitioner Advocates:Shafee Abdullah,Rahmat Hazlan ,Respondent Advocate: Norinna Bahadun

Possession of drugs entails knowledge inferred from physical control and surrounding circumstances, triggering presumption of trafficking under the Dangerous Drugs Act.

Headnote:The appellant was convicted of drug trafficking under the Dangerous Drugs Act 1952, specifically for possessing 49,621.8 grams of methamphetamine. The prosecution's case established custody and control over the drugs through corroborative evidence including possession of related items. The defense claimed ignorance about the drugs' nature, alleging they were personal belongings. The courts upheld the conviction confirming that actual knowledge can be inferred through possession and surrounding circumstances. The court noted that recovery of drugs and the appellant’s physical position established knowledge and trafficking presumption under relevant sections of the DDA. The final outcome affirmed the appellant's conviction.
