Beban pembuktian terletak kepada Pengadu untuk membuktikan ketidakpatuhan terhadap Award sebelum Mahkamah dapat bertindak di bawah s 56 APP 1967.

Headnote:(A) Akta Perhubungan Perusahaan 1967 - Seksyen 56(1) dan 29 - Permohonan perintah ketidakpatuhan terhadap Award - Syarikat Responden gagal hadir di mahkamah dan tidak mematuhi terma Award sebanyak RM32,000.00 - Mahkamah memutuskan terdapat ketidakpatuhan dan mengarahkan Syarikat Responden membayar baki RM29,500.00. (Paras 1, 7, 12, 14)

(B) Beban pembuktian - Terletak kepada pihak Pengadu untuk membuktikan ketidakpatuhan Award sebelum Mahkamah menggunakan kuasa di bawah s 56(2). (Paras 10, 11)

Facts of the case:
Pengadu memohon perintah ketidakpatuhan di bawah s 56(1) APP 1967 berkenaan Award yang tidak dipatuhi oleh Syarikat Responden, yang hanya membayar RM2,500.00 daripada jumlah RM32,000.00.

Findings of Court:
Mahkamah mendapati bahawa terdapat ketidakpatuhan oleh Syarikat Responden ke atas Award dan mengarahkan pembayaran baki RM29,500.00.

Issues: Adakah terdapat ketidakpatuhan oleh Syarikat Responden terhadap Award?

Ratio Decidendi: Mahkamah memutuskan bahawa Pengadu telah membuktikan ketidakpatuhan Award dan tiada alasan khas untuk mengubah terma Award.

Result: Syarikat Responden diarahkan mematuhi Award dan membayar baki RM29,500.00.

AWARD

Wan Jeffry Kassim:

[1] Ini adalah permohonan untuk satu perintah ketidakpatuhan di bawah s 56(1) Akta Perhubungan Perusahaan 1967 ("APP 1967") yang difailkan dalam Borang S pada 6 September 2023 di bawah k 24A Kaedah-Kaedah Mahkamah Perusahaan 1967 berkenaan No Award: 1498 Tahun 2023 ("Award") yang diperturunkan pada 10 Julai 2023 antara Amr Kadib Alban ("Pengadu") dengan Awesome Learning & Training Center Sdn Bhd ("Syarikat Responden").

[2] Kes ini telah ditetapkan untuk bicara sebelum ini pada 13 Mei 2024 tetapi telah ditangguhkan kerana peguam Syarikat Responden memaklumkan melalui emel bertarikh 13 Mei 2024 tidak dapat hadir kerana mempunyai kes di Mahkamah Majistret Kota Bharu (No Kes: DA- 379-05/2023). Lanjutan daripada itu, Mahkamah telah menetapkan tarikh bicara yang baru pada 27 Mei 2024 dan sekali lagi peguam Syarikat Responden melalui emel bertarikh 24 Mei 2024 memohon kes ditangguhkan kerana mempunyai bicara pada tarikh tersebut di Mahkamah Majistret di Seremban (Guaman No: NA-76J-36-02/2024). Walau bagaimanapun permohonan peguam Syarikat Responden tersebut dibantah oleh peguam Pengadu dan Mahkamah telah memaklumkan kepada peguam Syarikat Responden permohonan penangguhan tersebut ditolak dan tarikh bicara pada 27 Mei 2024 tersebut dikekalkan.

[3] Semasa kes ditetapkan untuk bicara pada 27 Mei 2024, pihak Syarikat Responden dan peguam Syarikat Responden tidak hadir dan Mahkamah ini menurut peruntukan s 29 APP 1967, memutuskan perdengaran perbicaraan dibuat secara ex-parte. Seksyen 29 APP 1967 memperuntukkan seperti yang berikut:

"Power of the Court

29. The Court may, in any proceedings before it:

(d) hear and determine the matter before it notwithstanding the failure of any party to submit any written statement whether of case or reply to the Court within such time as may be prescribed by the President or in the absence of any party to the proceedings who has been served with a notice or summons to appear;"

[4] Prinsip undang-undang pendengaran perbicaraan secara ex-parte telah kerap kali diputuskan oleh Mahkamah Perusahaan. Sebagai panduan rujukan dibuat kepada kes Wong Brothers' Building Construction v. Choo Chee Siam; [2005] 2 ILR 356, di mana Mahkamah telah memutuskan untuk meneruskan pendengaran perbicaraan secara ex-parte. YA Pengerusi yang bijaksana telah di ms 363 memutuskan inter alia, seperti yang berikut:

"The Court is mindful of the role in ex-parte hearing by referring to the case of Ike Video Distributors Sdn Bhd v. Chan Chee Bin; [2004] 2 ILR 687 where the Learned Chairman quoted from the book "The Law of Industrial Disputes" by OP Malhotra Vol 3rd Edn at p 716:

A rule empowering the tribunal to proceed ex-parte if a party is absent and sufficient cause is not shown for his absence, would not enable it either to do away with the inquiry or straight away pass on an Award without giving finding on the merits of the disputes. In other words, the absence of a party does not entail the consequence that an Award will straightaway be made against him"

[5] Prinsip undang-undang yang sama juga diikuti dalam kes Manimaran Karuvanan v. Tav Facility Solution (M) Sdn Bhd di mana perbicaraan kes telah juga dijalankan secara ex-parte tanpa kehadiran pihak syarikat responden berdasarkan peruntukan s 29 APP 1967. Mahkamah Perusahaan di dalam kes ini telah memutuskan bahawa:

"As such, both parties had been sufficiently informed of the hearing dates fixed for this case. However, the Company failed to turn up in Court on the Hearing date. Hence, the hearing was ordered to proceed ex-parte pursuant to s 29(d) of the IRA 1967. In relation to this, the Court is guided by the case of Lee Mei Wan v. Ultimate Media Group Pte Ltd 10. It was observed that:

[4] Subsection 29(d) of Act 177 provides for an ex-parte hearing without the presence of one of the parties to the dispute as follows:

The Court may, in any proceedings before it:

(a)...

(d) hear and determine the matter before it notwithstanding the fail
