JUDGMENT

Augustine Paul J:

Two charges of rape were preferred against the accused in the Sessions Court at Kuala Lumpur. The charges read as follows:

First Charge

Bahawa kamu, pada 10hb Oktober 1999, jam lebih kurang 5.00 pagi di dalam sebuah bilik di rumah no. 10-2, Jalan 5A/6, Taman Setapak Indah, Setapak, dalam daerah Sentul, dalam Negeri Wilayah Persekutuan Kuala Lumpur, telah merogol Suhailiah Bt Bajoori KP: 790813-01-5760 dan dengan itu kamu telah melakukan kesalahan yang boleh dihukum di bawah Seksyen 376 Kanun Keseksaan.

Second Charge

Bahawa kamu, pada 10hb Oktober 1999, jam lebih kurang 11.00 pagi di dalam sebuah bilik di rumah no. 10-2, Jalan 5A/6, Taman Setapak Indah, Setapak, dalam daerah Sentul, dalam Negeri Wilayah Persekutuan Kuala Lumpur, telah merogol Suhailiah Bt Bajoori KP: 790813-01-5760 dan dengan itu kamu telah melakukan kesalahan yang boleh dihukum di bawah Seksyen 376 Kanun Keseksaan.
