SARAWAK BANK EMPLOYEES UNION – Appellant
Versus
SARAWAK COMMERCIAL BANKS ASSOCIATION – Respondent

Table of Content
1. definition and importance of trade disputes and collective agreements (Para 7)

[7] Section 2 defines a trade dispute simply as a dispute between an employer and a trade union of workmen which is connected with the terms and conditions of employment. What is to be noted here is that the definition is very wide and the law empowers the Industrial court to sort out the issues between the employer and union. This has been endorsed by the Federal court decision in Dynamic Plantations Bhd v. YB Menteri Sumber Manusia & Anor, 2010 MarsdenLR 389 . Further, the Industrial court in the case of Hagemeyer Industries Sdn Bhd v. National Union of Commercial Workers (Award 75 of 1983) stated that the definition of 'trade dispute' was wide enough to cover every dispute between employer and his workmen which is connected with the service of the workmen or with the benefits incidental to that service.
